1. I therefore reject the submission that a public nuisance requires an unlawful act. 2. It should be noted that an omission is not sufficient for unlawful act manslaughter and that neglect and negligence are not the same thing. 3. The unlawful act was arson, and he was reckless as to the risk of injury. 4. Without that state of mind there was no unlawful act manslaughter when the accused stabbed his brother who was trying to restrain him. 5. There must, therefore, be a mental element in the unlawful act, though this proposition is not always stated in the cases. 6. The requirement of mens rea for unlawful act manslaughter may be easily satisfied. |
