1.   A State is free as well to reconfigure its remedial scheme over time, to fit its changing needs.

2.   By instructing juries in Jones Act cases accordingly, courts can give proper effect to the remedial scheme Congress has created for injured maritime workers.

3.   Such an approach, however, would run counter to our prior decisions and our understanding of the remedial scheme Congress has established for injured maritime workers.

4.   The remedial scheme the majority creates today is neither sensible nor faithful to Spending Clause principles.
