1. Equity only protects the bonafide purchaser for value of a legal estate and so the rule should be of no application. 2. It is therefore abolished as a legal estate. 3. Lord Wellworthy can enforce the covenant only whilst he retains the legal estate in the Stately Mansion Hotel. 4. One might imagine, for instance, that it has turned equitable estates and rights into legal estates and rights. 5. A legal estate is not capable of subsisting or of being created in an undivided share in land or of being held by an infant. 6. A legal estate is the right to possess land for a determinate or an indefinite period of time. 7. The governing relationship with which this case is concerned is that of a beneficial owner of the legal estate selling the freehold to a purchaser. 8. A beneficial owner is therefore one who owns the legal estate for the benefit of him or herself. |
