1. A person who is subject to a statutory duty can not discharge that duty by entrusting responsibility for its performance to some one else. 2. But trust in the authority is trust that the authority is likely to discharge its duties properly. 3. He has been twice a Member of Congress, and in that office discharged his duty with ability and faithfulness. 4. The trustees failed to discharge their duties properly. 5. In none of these cases can the inanimate subject of help be conceived as relaxing, coming round, getting in ahead of someone or discharging duties. 6. In doing so they had discharged their duty of care. 7. The legal effect of a sufficient warning under this section is to discharge any duty of care which might have been owed by the occupier. 8. A simple notice saying Danger will not discharge the duty. |
