1.   At a private hearing in Torquay, a judge granted a residence order which allows her to continue living with her grandparents.

2.   But it is obviously undesirable to have exparte residence orders other than very occasionally.

3.   Nothing is said about residence orders, either that they can be made or that they can not be made exparte.

4.   Thus, a parent or any other person seeking a residence order in relation to a child in care must apply to the court which made the care order.

5.   This is because the making of a residence order with respect to a child in care discharges an existing care order.

6.   State Police Management Department chief Superintendent Abdul Wahab Azizul Hassan said yesterday the eight were subsequently served restricted residence orders.

7.   In addition, the court said the couple could apply for a joint residence order which would give them full parental responsibility according to English law.
