1.   In the present case the plaintiff did not allege, nor did the judge find, any bad faith by the defendants.

2.   The judge found for the plaintiff.

3.   The judge found that it was not foreseeable that the fuel would catch fire.

4.   The judge found the defendants to have been in breach of the injunction and committed each to prison for four months.

5.   The judge found that in her case there were mitigating circumstances.

6.   The judge found that to be convicted of this offence the Crown must establish that an accused posed a danger to the general public.

7.   The trial judge found that it was not foreseeable that fuel oil on water would catch fire but there was some foreseeable damage in the fouling.

8.   The trial judge found that there was a bare possibility of fire damage but that this was so remote it could be ignored.

9.   The trial judge found this amounted to negligence.
