1.   It must be shown how it affected administration of the bankruptcy estate.

2.   It says the money should be returned to the bankruptcy estate because Symington knew at the time that he was insolvent and headed toward bankruptcy.

3.   The money likely will be turned over to the bankruptcy estate in January.

4.   The trustee of the bankruptcy estate, meanwhile, also has been angling for Symington.

5.   The trustee also alleged in a separate motion that petitioner had, despite requests, failed to turn over all the books and records relating to the bankruptcy estate.

6.   The company, in a statement, said civil settlement talks were with the University of California regents, the Enron bankruptcy estate and other company creditors.
