1.   The testimony of the two arresting officers was an important part of the prosecution case.

2.   The arresting officer failed to inform the suspect of his rights.

3.   If the accused seriously harms an arresting officer, without maliciously he would be guilty if he foresaw any harm at all.

4.   Arresting officers determined that his license and automobile registration appeared improper.

5.   At no time did they point their guns at the arresting officers.

6.   At least one other man among those picked up has alleged in a civil suit that he was beaten by arresting officers.

7.   At the same time, he attacked the credibility of the arresting officers and chastised all officers who work in the neighborhood, Washington Heights.

8.   A broken refrigerator blocked his escape, said Sacramento Sheriff Detective Chris Joachim, the other arresting officer.

9.   A police official said the arresting officer was not disciplined.

10.   According to the police report signed by the arresting officer, Sgt. Mike Maycen, Gilkey failed three sobriety tests and refused to take a breathalyzer test.
