61.   The judgment for the majority in the Court of Appeal was given by Nourse LJ who held that there had not been a sale by description.

62.   The sale is of goods which, by the very description under which they are sold, appear to be sold for a particular purpose.

63.   Essentially a sample is a non-verbal description and whether or not a sale is by sample depends upon the intention of the parties.
