21.   Do you have a system for keeping the witness informed of the progress of the claim where trial is likely to be delayed?

22.   Do you know dates when the witness may not be available to give evidence?

23.   Do you have sufficient information to contact the witness at short notice on the eve of trial?

24.   Civilian witnesses are notoriously unwilling to assist unless pressed, particularly if they have already been obliged to give evidence in criminal proceedings.

25.   Attendance of witnesses A witness can be compelled to attend the hearing and produce specified documents by issue of a witness summons.

26.   In cases of doubt it is for the court to decide whether a witness is an expert or not after considering his qualifications and experience.

27.   If that witness would be the child, however, reliance on hearsay evidence may be justified to avoid putting the child through the trauma of giving evidence.
