1.   Both countries have been implicated in fostering terrorism, and Libya has refused to surrender two suspects in the Pan Am bombing.

8.   But the Serbs have rejected Tribunal authority and refused to surrender suspects, making it unlikely the court will get its hands on any big names.

9.   Gadhafi has been reluctant to surrender the suspects, seeking guarrantees over their imprisonment, if they are convicted, and over the lifting of sanctions.

10.   However, rather than intervening directly, the court should ask the Security Council to pressure the country to either prosecute or surrender the suspects.
