1.   Unless the injured student was very young, this would usually prevent him or her from recovering damages against a negligent teacher.

2.   Cairney has little hope of recovering damages under the breach of contract claim, since punitive awards are usually minimal in those cases.

3.   The proposed EU-wide regulation would provide a mechanism for recovering damages awarded against European companies under the Helms-Burton law through counter-suits in Europe.

4.   It would also provide a mechanism for recovering damages awarded against them under the recently passed Helms-Burton Act through counter-suits in Europe.
