8.   Brussels regularly sends out warnings that a government is breaking community law, or it sends serious cases to the European Court of Justice.

9.   But our constitutional freedom depends on not allowing the government to break the rules when it moves against unpopular individuals or interests.

10.   Congress is questioning the legality of the exchange, however, arguing that the government broke the law by not informing it beforehand.
