1.   The producer of a defective product is liable for damage resulting wholly or partly from that defect.

2.   Therefore, in dealings between businesses, the product liability part of the Act will only apply to defective products causing death or personal injury.

3.   A consumer who suffers physical damage from a defective product now has a choice between the common law and the statutory actions.

4.   The common law on defective products was subjected to a number of criticisms.

5.   Liability for defective products is covered by Part I of the Act.

6.   Its purpose is to introduce a strict liability regime on producers of defective products.

7.   It is necessary that a person supplied a defective product for there to be liability and this supply must be in the course of a business.

8.   The claim may not include damages for damage to the defective product itself.

9.   The limitation period for actions under the Act runs for three years from the date on which the damage was caused by the defective product.
