1.   The court held that this should not have happened if due care had been used and the doctrine was applied.

2.   However this was described by the Court of Appeal as a device and the doctrine was applied.

3.   And, the federal courts have demonstrated that they can apply this doctrine in a careful and reasoned manner, with sensitivity to the effect on competition.
