1.   Johnson, serving a life term for aggravated rape, remains in prison and could not be reached for comment.

2.   The murder charge was dropped for lack of evidence, but Criner was convicted of aggravated rape, even though no physical evidence linked him to the scene.

3.   The suit initially was filed by Daniel Johnson, who is serving a life sentence for aggravated rape in Harris County.
