71.   The two parties will then exchange counter-offers, until one party accepts the counter-offer of the other, whereupon the contract then comes into existence.

72.   Some courts will made an order ex parte on production of a consent signed by the other parties.

73.   Every party should, so far as practicable, apply for any particular direction he may desire on notice to the district judge and the other parties.

74.   A copy of the amended pleading is sent direct by the party filing to the other parties.

75.   Notice must be given also to the court with a certificate that notice has been given to the other parties.

76.   Failure to disclose means that the leave of the court or agreement of the other parties must be obtained before expert evidence can be adduced.

77.   Where the maker of a witness statement served on the other parties is not called at trial, no other party can put the statement in evidence.

78.   An awkward party could block the procedure by declaring unacceptable every expert or appointing individual or authority put forward by the other party.

79.   Difficulties can arise if one party refuses to disclose a document which the other party wishes the expert to see.

80.   The suggested procedure in Appendix A states that each party is to send its submission to the expert and copy it to the other party.
