11.   Texas bill sponsor Sen. Rodney Ellis, who contends the state has executed six retarded defendants, called the veto embarrassing.

12.   Texas does not have a ban, and the state executed two retarded defendants while he was governor, according to the Death Penalty Information Center.

13.   The panel also recommended banning the death penalty for mentally retarded defendants and defendants convicted solely on the evidence of a single eyewitness, informer or accomplice.

14.   The ruling is confined to mentally retarded defendants convicted of murder and does not address the constitutionality of capital punishment in general.
